2. Services Overview
Web development
We provide scoped web development services such as promotional websites, multi-page builds, and related deliverables described on our web development page or in a written proposal, statement of work, or invoice. Unless expressly included in writing, web development does not include ongoing hosting management, domain registration, or legal compliance review.
SEO and digital marketing
We provide ongoing or project-based SEO and marketing services such as on-page optimization, content support, local visibility work, and reporting, as described on our services page or in a written agreement. Scope, cadence, and fees are confirmed before work begins.
3. Eligibility
By using this website or purchasing our services, you represent that you are at least 18 years old, have legal capacity to enter a binding agreement, and are not prohibited from doing so under applicable law.
4. Booking and Payment
Projects and retainers are booked through our scheduling tools, email, or other channels we specify. A booking is confirmed upon receipt of payment unless otherwise agreed in writing.
Payment is due as stated at checkout, in an invoice, or in a signed scope document. All prices are in U.S. dollars unless noted otherwise. We may update pricing for future engagements; confirmed bookings are not affected by later price changes.
Payments are processed through secure third-party payment processors. By providing payment information, you authorize us to charge applicable fees. JZB Consulting, LLC does not store full payment card details.
5. Cancellation and Rescheduling
For scheduled discovery calls and meetings:
- Cancellations or reschedule requests made at least 24 hours before the scheduled time will be accommodated without penalty when possible.
- Requests made within 24 hours may result in forfeiture of that appointment.
- No-shows without prior notice may be treated as completed; no refund or credit is issued.

6. Refund Policy
Because web projects and marketing retainers involve reserved capacity and scoped deliverables, sales are generally final. Refunds may be considered on a case-by-case basis at our sole discretion when services have not yet been rendered.
For web development, deposits and milestone payments are non-refundable once work on that milestone has begun, unless otherwise stated in your written scope. Contact us with concerns before disputing charges with your bank.
7. Web Development Terms
When you engage us for web development:
- Scope: Deliverables, timelines, revision rounds, and fees are defined in a proposal, invoice, or statement of work. Work outside scope requires a written change and may incur additional fees.
- Client materials: You are responsible for providing accurate copy, branding assets, approvals, and access (for example domain or hosting credentials) needed to complete the project on time.
- Revisions: Reasonable revisions within agreed scope are included as stated in your project agreement. Additional revision cycles may be billed separately.
- Acceptance: Deliverables are deemed accepted if you approve in writing, publish the work, or do not provide written rejection of material defects within 14 days of delivery, whichever comes first, unless your written agreement states otherwise.
- Intellectual property: Upon full payment, you receive the rights agreed in your scope to use the final deliverables for your business. We retain ownership of pre-existing tools, templates, and know-how. We may display completed work in our portfolio unless you opt out in writing before launch.
- Third-party services: Hosting, domains, analytics, forms, and plugins may be provided by third parties subject to their terms and fees. We are not liable for outages, policy changes, or costs imposed by those providers.
- Warranty disclaimer: Sites are provided “as is” after delivery except for fixing material defects in our original work within any warranty period stated in writing. We do not warrant uninterrupted operation, compatibility with all future browsers, or specific business results.
8. Client Responsibilities
By engaging our services, you agree to:
- Provide accurate, honest information about your background, goals, and project needs
- Participate in good faith and meet agreed timelines for feedback and approvals
- Provide timely feedback, approvals, and access needed to stay on schedule
- Maintain professional, respectful communication
9. Intellectual Property
All content we create, including code (until transferred per your agreement), copy, designs, and marketing materials, is owned by JZB Consulting, LLC unless assigned in writing. You may not reproduce, distribute, publish, sell, or create derivative works without prior written permission.
10. Confidentiality
We treat personal and business information shared during engagements as confidential and do not disclose session or project details to third parties without your consent, except as required by law or described in our Privacy Policy.
Our proprietary methods and internal processes shared during projects are confidential. You may not share, reproduce, or distribute them without written permission.
11. Limitation of Liability
To the maximum extent permitted by law, JZB Consulting, LLC and Jeordan Burkhart shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or financial losses arising from use of this website, our services, or decisions made based on information we provide. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid us in the 30 days preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless JZB Consulting, LLC and its owner from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of our services, violation of these Terms, content or materials you supply, or financial or business decisions you make.
13. Termination
We may suspend or terminate access to services if we believe you violated these Terms, engaged in harmful or disrespectful conduct, or for other reasons at our sole discretion. Termination for cause does not entitle you to a refund for unearned project fees or unused retainer periods.
You may discontinue services at any time, subject to cancellation, refund, and payment terms above.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of state and federal courts located in Ohio.
Before starting formal legal proceedings, you agree to contact info@jzbconsult.com and attempt to resolve the dispute informally within 30 days.
15. Entire Agreement
These Terms, together with our Privacy Policy, Disclaimer, and any written proposal or statement of work for a specific project, constitute the entire agreement between you and JZB Consulting, LLC regarding use of this website and our services. They supersede prior oral or written communications on the same subject.
16. Changes to These Terms
We may update these Terms at any time. Changes are effective when posted at jzbconsult.com/terms-of-service. Continued use of the website or services after updates constitutes acceptance of the revised Terms.
